Not in this case. Hate speech is determined and defined by the forum owner. He made that vividly clear in his comments to Jim Crow. He also indicated that his judgment on the subject was not open to negotiation or debate. Your (our) only choice, as participants who enjoy the forum privileges which Midnitecrow makes available, is whether to accept those terms, or to cease posting here.
There are numerous restrictions on speech, in the US, and everywhere else. And continued membership in almost ANY group is predicated upon adhering to expectations of reasonable conduct -- depending on the specific context or situation. What is appropriate in one context is totally outrageous (or even illegal) in another. Would you seriously propose, for example, that one could call their boss an asshole, and expect to retain their job because they were exercising their free speech rights? Naive much?

Your comments to Midnitecrow were overtly insulting and challenging. If you can't see that, it might be a sign of the 'pervasive insensitivity' I commented on above.

Even if your attempt was to inject humor, there is the issue of context; the tone of Crow's message to Jim Crow made it clear that he considered his message to be both serious and important. That's hardly the proper time to attempt a joke. Your comments, when viewed as an attempt at humor, were inappropriate given the circumstances in which you applied them. Another example of insensitivity, at a minimum.
Additionally, I take exception to your suggestion that I lack a sense of humor. Please refer to my post titled "So ugly even a mother couldn't..." I consider it a distinct possibility that I generated a laugh or two with that one. Not from you, of course...but from someone.

Nonsense. I'm neither limiting your speech, nor attempting to. I'm simply pointing out that your methods of communicating have, in my opinion, negative consequences that affect the rest of us. I've been quite specific, pointing out your frequent use of platitudes (including in the post I'm commenting on), and the negative consequences of that behavior. I've noted your reliance on insults (including, again, in the post I'm commenting on) in lieu of actual content, and I've suggested that you exhibit a pervasive insensitivity to situation and context. Finally, I've implied that the phrase 'ugly American' provides a pretty good thumbnail description of the weaknesses in your general approach. I'm not surprised you don't like or agree with these observations, however, what I'm doing so I'm simply exercising my free speech rights. And I'm exercising those rights while complying with the rules of conduct which apply where I'm doing so.
